    I was wondering if there was any kind of legal issue concerning Fire Marshals. We have one thet the fire dept voted out, but city council over ruled our vote. He is not certified in fire investigations, or inspections. Although he works in the city's code enforment dept.

    Yhis is an all vol. dept. he cant determin the origin of a fire if it were looking him in the eye. We had a house fire not long ago, the ladie that lived there told us how the fire started, and he still ruled it ELECTRICAL. That is is the only thing he knows.

    Is there anything legal we can do to get him out of this office.
    - he could never get certified through texas commision due to a criminal record.

    You have already stated the answers...first,he is not certified for the position he holds...second,he has had a criminal record.

    Your best bet is to contact your State officials and bring these things to thier attention,next,bring it before the people in your State so that they,themselves,may either impeach him or vote him off the ballads.

    Most things in the Fire Services are revolved around politics more than legal issues and it will take the people to do something about it rather than lawyers.
