    Hello all,
    There have been a bunch of questions recently regarding background investigations. Many people believe they can have their record expunged to make their past indiscretions magically disappear. Here is the answer from my background investigator in regards to a candidate with an expunged record.

    The expungement clears their court record, however it essentially does not have an effect on the background. We still want to know all the information to complete the background. The questions that are asked in a BG would still need to be answered with a yes or no (arerested, booked, convicted, etc).



    An expungment doesnt change anything we do.

    Not only that, if you were fingerprinted a criminal tracking number is generated, (CTN). This will be reflected on an unedited complete criminal history, as there are three segments on that.
    The arrest segment. (What they initially charged you with). The charge segment. (What the prosecutor/district attorneys office approved as charges). And final disposition. (convicted, pled, dismissed, etc.).
    the bad part of this system is you could be wrongfully/erroneously arrested, and yet an arrest for say rape, would still appear on your criminal history, even though you may have never even been charged.
    Don't hide or ignore past issues. It takes away your ability to clarify. A good, competent background detective knows mistakes on criminal histories occur, as well as bad arrests happen and can clear up alot with your help. When folks get told something is coming off due to error, status or expunge it often doesn't. Most offices are busy, overloaded, and barely can keep up with new cases, let alone old stuff. You must check and verify they did what they say they will do.

      More and more threads are being started everyday with questions regarding past criminal convictions. I think Firehouse needs to make another section of forums for criminals. LOL

        i've used ussearch.com and my state's criminal background search service and my record shows up clear. I had one minor mishap in 2005 where I was detained but then let go and never had a charge against me. Now i've heard mixed advice, since nothing was ever put on my record I should not even bring it up. or should I just list it even though nothing is there... i'm on the fence here...

          It is possible that disclosing expunged records depends on state laws. I know that police agencies in Oregon do not require you to disclose any expunged records. I'm not sure about the fire departments there but I assume the police background would be stricter so I would be surprised if the FD's require disclosure. Now I this doesn't mean they wont find out about it, but they don't require you to disclose it.

            Have you visited the city, county or whatever that detained you

            And have them run your name?

            We go to the city/ county that you have lived/ worked in and check your name

            We have found some interesting stuff with NO arrests involved

              I would say..."If you have EVER been " in regards to any ticket,court case,conviction or misdemeanor I would answer honestly as you really do not know if "That State" does or does not keep their records expunged.
