  • Juvenile misdameanor effect my chance of getting hired??

Hello, my name is joe, I live in phoenix arizona and im 19, when i was 16 I had a domestic dispute with my mother, she called the cops and me and claimed I pushed her down, I have two misdameanors, assault, and criminal damages. I went and did the diversion, so technically i was never convicted, and I have gotten the charges expunged

If I'm applying for a firefighter and tell them about the situtation will it make the chances of me being hired slim? If I avoided telling them, will they find it in the background check even though i was a juvnile and the record was expunged??

    thank you

the worst part about it was the police report makes it look very....bad, I never even came close to striking my mother but she was scratching and slapping me and I grabbed her wrist and the criminal damages are because when i was leaving the house I slammed my door which cause it to crack

the assault was just "simple assault" I believe, I think the lightest form of assault. I know its off my record, but that the police department may still have it on record, would they find it?

        It was 3 years ago?

As long as you haven't had anything on your record since then you should be fine since it happened when you were a minor.

Definitely tell your background investigator about it. They'll find it.

All things are considered in the hiring process, both good and bad. Of course you want to have only good and a lot of them, but most everyone has something: a speeding ticket, bad credit, being let go from a job, something that is considered a “Ding”. The thing you want to do is put as much distance between yourself and the things that happened in your past.

I would say that it would be better to have a Ding in your record when you were young than latter in life. You never want to try and hide what happened but also can say, “I can’t believe I was ever that young and immature, I have come so far and matured so much since, I can’t believe that was me”.

A few years, a bunch of classes and some experience behind you and I don’t think you will have a problem. But it will come up, be prepared.
          Good Luck, Capt Rob

Read what each application asks for

May ask for allconvictions and arrests

We added even if it has been cleared by the courts

First of all there is no such thing as an expunged record. Secondly, once is bad, twice is a pattern. This will not bode well for you in the hiring process.

I do agree with everything Rob said with the exception of the fact that it won't be a problem. Time, distance and shielding (similar to a haz mat call) are your best friend.

Both of the misdameaners occured during the same day, so would they still see that as a pattern?

It depends. Did the cops come out for one incident and then have to return for a second time?

I have two petty offenses (MIP) and one misdemeanor for giving a cop the middle finger in 2003. Obviously, I was pretty stupid when it came to alcohol. All of these were over 8 years ago. I haven't had any other problems and have a clean driving record. I'm getting ready to go through this process and I think since it was so long ago I’ll be fine. I think Chief Lepore is right, Time, Distance, and Shielding.

I just recently got hired and I had a misdemeanor for drinking under age, it was about 9 years ago. I talked about it in my interview and owned my mistakes, you should be fine going through the process. Good luck I hope you get an offer!

Yeah i'm just worried about the frequency issue. I haven't had my background interview yet but I expect to have it in the next month or so. I'll keep you updated.

I wouldn't stress about it, its in the past. Be honest with your BI and they should understand. What process are you going through if you dont mind me asking?
