Judge gives burglar a break in Dudley case
A year in jail, but no restitution

WORCESTER— A California man received an early Christmas gift yesterday, when a judge gave him a lesser sentence than what his own lawyer had settled on with the district attorney’s office.
Matthew D. Carr, 34, was sentenced to a year in jail for the 2000 burglary of a Dudley home owned by a restaurateur.
The sentence came after Mr. Carr pleaded guilty to larceny from a building and breaking and entering during the daytime with intent to commit a felony, and had a charge of conspiracy dismissed as part of a plea deal.
According to court testimony, Mr. Carr joined with two others in breaking into a home in Dudley, and stealing a safe that contained $15,000 to $20,000 in cash and $35,000 worth of jewelry. One of his accomplices has pleaded guilty, and was sentenced to five years’ probation. She allegedly confessed to the crime and implicated Mr. Carr.
His lawyer, Tom G. Vukmirovits, had negotiated a plea deal with the district attorney’s office to have Mr. Carr serve a year in jail and pay $35,000 in restitution. The lawyers left any recommendation of probation for Superior Court Judge Frances A. McIntyre to decide. Mr. Carr had asked for no probation, so he could begin working to pay off the restitution immediately after his release from jail.
Judge McIntyre set no probation. Moreover, she noted that Mr. Carr was wanted on the Dudley charge when he was an inmate in California on separate charges, and that California prison officials did not allow him to take part in any work development programs while he was waiting to be transferred to Massachusetts.
Judge McIntyre said the lack of training programs are a setback in Mr. Carr’s efforts to get a job once released, so she also eliminated the restitution payment, which came as a surprise to the lawyers and Mr. Carr.
Ah what the heck, those mean people in California didn't give you any vocational training, so we're not going to impose probation or restitution on you! WTF?
