Man Can Sue Woman For Sperm Theft Distress

CHICAGO (AP) A woman accused of using her lover's sperm to impregnate herself without his knowledge can be held liable for the unwitting father's emotional pain, the Illinois Appellate Court has ruled.

In the ruling released Wednesday, a three-judge panel reinstated part of a lawsuit against Sharon Irons, a doctor from Olympia Fields. The ruling sends the case back to Cook County Circuit Court.

Irons was sued by her former lover, Chicago family physician Richard Phillips, who accused her of a "calculated, profound personal betrayal" of him after a brief affair they had six years ago.

Phillips alleges that he and Irons, who practices internal medicine, never had intercourse during their four-month affair, although they did have oral sex three times.

His suit contends that Irons, without his knowledge, kept some of his semen and used it to impregnate herself.

The relationship ended when Phillips learned Irons had lied to him about being recently divorced and was, in fact, still married to another doctor, according to court documents.

Nearly two years later, Irons slapped Phillips with a paternity suit. DNA tests showed Phillips was indeed the father, court papers state.

Phillips then sued Irons, claiming her actions robbed him of sleep and caused him to have trouble eating. He is haunted by "feelings of being trapped in a nightmare," court papers state.

Irons responded that her alleged actions weren't "truly extreme and outrageous" and that Phillips' pain wasn't bad enough to merit a lawsuit. The circuit court agreed and dismissed Phillips' suit in 2003.

But the higher court ruled that, if Phillips' story is true, Irons "deceitfully engaged in sexual acts, which no reasonable person would expect could result in pregnancy, to use plaintiff's sperm in an unorthodox, unanticipated manner yielding extreme consequences."

But the judges agreed with the lower court's decision to dismiss fraud and theft claims against Irons.

They agreed with Irons' lawyers that she didn't steal the sperm.

"She asserts that when plaintiff 'delivered' his sperm, it was a gift -- an absolute and irrevocable transfer of title to property from a donor to a donee," the decision said. "There was no agreement that the original deposit would be returned upon request."

Who in there right mind thinks of coming up with that agreement prior or post of receiving those actions!

So if this female were to ring this Dr's doorbell, hand him (presumably) a sperm container of some sort and say "Since we are no longer together, I think I should give this back to you." He would be much happier?
Is the issue:
a) that he is a father without his knowledge/consent?
b) that the female went about achieving pregnancy in a (slightly) unorthodox manner?
c) that the father is worried he would be liable for child support?
d) that the donor has no control after making his deposit?
e) that the donor can't get his deposit back?
f) that he had other plans for his sperm?
g) that the mother is not going to be a "fit" mother in his opinion?


I could go on for a bit but I will take mercy on my fellow readers:)

ok so I'm confused......... IF she indeed pirated his sperm away after an oral interlude ...... wouldn't it be contaminated with saliva, how viable would it still be, can swimmers survive a less than sanitary place? Did she run and spit (in a cup) right away....... BAD girl, everyone knows it's not ladylike to spit :D. Also, if this wasn't her collection method, how could he NOT notice her with a collection recepticle????

Anyone ever think that PERHAPS this man is not being all truthful in his story. I just find this REALLY hard to believe!!!!

I mean, what would you do, spit, rush him out the door saying " sorry honey I suddenly feel the need to "baste" something" ??? She would have had to inseminate soon after the oral act took place as sperm do not survive long outside the body and in less than ideal conditions.

This psychotic, conniving little woman premeditated this whole ordeal!!She practically admits doing it when she calls him a "donor" and says that she contends that the sperm was a "gift" and therefore was her property. WOW!!!!!!! She probably just got up, went to the bathroom and somehow did what she wanted to do with his sperm. Or put it in a container, stopped by her freezer on the way back to the bedroom and left "her" deposit to be used later.Why is that so hard to believe? If she was a doctor, Im sure she was had access to the things that would be needed to store and then later use the sperm. Since the tests show he was the father, this must have been how she did it. I doubt both parties would agree with this story unless it was true. That being said, what must be wrong with a person who would impregnate themselves the way that this woman did?

There are so many things I want to say here, but I think I would get yelled at so I am just going to play stupid for a minute and ask a question.

Now this is coming from a guys standpoint... If she indeed 'held' on to her 'gift'... how the heck would you not notice it? I mean really did she stop talking, etc and sprint out of the room? In case you didn't know this already... something is a little bit strange here!

The article I saw said that the court has already ordered him to pay $800 per month in child support. That was the reason for the paternity test in the first place.
