My fellow Texans I just wanted to let you know about house bill 3423 which as of September is now law.

H.B.3423 is a new law that deals with the issue of new borns (less than 30 days old) being abandoned and left in dumpsters on door steps ect. The bill states that persons who drop the child off with an emergency service provider shall not be in violation of the law, and not be procecuted for abandonment.

This law states that emergency service providers who takes posesstion of a child shall perform any act necessary to protect the physical health and safety of that child. Here is the catch, No later than the close of the first business day after the date on which the ems provider takes possession of a child the provider shall notify the department of regulatory services that the provider has taken possession of the child. The department shall assume care ,control and custody of the child immediately on receipt of the notice.

I this act happens on Friday night you could have to care for this child until Monday when you can report to the department of regulatory sevices and subsequently assume care.

This bill has a good intention of protecting our childer, however not many providers know this law is in effect and I know that most of us are not prepared to care for an infant for little more that a few hours, I urge you to call your local representive so we can get 24 hour support for the department of regulatory services.
