New D.C. Gun Restrictions Unveiled

WASHINGTON -- The D.C. Council is set to vote Tuesday on emergency legislation unveiled Monday that imposes strict controls on handguns and rules for registering firearms in the District.

The new regulations come after the Supreme Court struck down the city's 32-year-old ban on handguns last month, ruling in District of Columbia v. Heller that Americans can keep guns at home for self-defense.

Handguns will still be banned, except for self-defense in the home, city officials said at a noon news conference. Sawed-off shotguns, machine guns and short-barreled rifles are still prohibited.

Police will register one handgun per person for the first 90 days after the legislation becomes law, city officials said. A six-month amnesty period will be set up during which residents can register guns already in their possession.

Police will require ballistic testing on handguns before they are registered to see if the weapon was stolen or used in a crime, officials said.

The new legislation also modifies existing law to clarify that firearms must be stored unloaded and either disassembled or secured with a trigger lock, gun safe or similar device, officials said. There would be an exception for guns in the home that are being used against the "reasonably perceived threat of immediate harm."

The D.C. Council is expected act on the emergency legislation called "Firearms Control Emergency Act of 2008" during the July 15 legislative session.

Police Chief Cathy Lanier also announced new rules for registering firearms and licensing firearms dealers.

D.C. residents who want to register handguns must complete an application from MPD's firearms registration section, pass a written firearms test and provide photos, proof of residency and proof of good vision. They will also be fingerprinted.

Residents can take approved applications to licensed firearms dealers within the District to pick up their weapon. Weapons purchased from dealers outside the District must be taken to dealers in the city to complete the transaction. Ballistics tests will be performed before the weapons can be taken home, police said.

Police will allow residents to register handguns they already own for the next six months. The Office of the Attorney General will not prosecute residents for unregistered possession during this amnesty period, but people who have committed crimes with firearms will remain subject to prosecution, police said. People who bring a firearm from another jurisdiction into D.C. must take it to the Firearms Registration Section or notify the section they will do so within 48 hours.

Police also clarified rules for becoming a licensed firearms dealer. Dealers must be licensed by the federal Bureau of Alcohol, Tobacco and Firearms, among other provisions.

The possesion of a legally acquired and legally owned fire arm by a law abiding citizen does not automatically present a danger to anyone.

The fact that politicians have tried more times than I can count in my short time on this Earth to take my gun rights away a bit at a time is of greater concern to me than the citizens of DC having the legal right to defend themselves against the criminal element that already has guns.

Well, if the electorate of DC doesn't mind the flood of legal bills to fight such silly laws, shame on them.

It sounds like any new law would be challenged, so bring it on!

And they are legal where without a Class 3 license?

Funny how one of the most violent cities in our country still wants its citizens to jump through hoops to be able to protect themselves in their own homes. I never thought I'd say it but thank god I live in Florida.

No fur to fly. Just stop penalizing the law abiders while failing to arrest and jail the law breakers.

In my opinion there should be a federal law stipulating that anyone using a gun in the commision of a crime serve a mandatory 10 years in prison. This could not be plea bargained away despite any other agreements made and would be tacked onto the other sentence not served at the same time.

Wide scale ballistic testing has proven to be a dead horse in other cities around the nation.

Operation Exile in Richmond, Virginia proved this under President Clinton when the local and federal government punished people commiting violent crimes involving guns by using EXISTING LAWS.

You broke the law, you went to jail. If you used a firearm in the commission of that crime, you paid by serving more time under the federal statutes. Lots od people went ot jail, the prisons got jammed, the community activists got ticked because people were in jail for too long so they stopped the program.

Crime went down during the program, but went up after they stopped being so prosecutorial and enforcing the laws.


Instead, I get punished for following the laws. I love the moronic mentality of it all.

Most gun laws do nothing to stop the illegal use and trafficking of weapons. I will venture to guess that these proposed DC gun laws will have the same effect.

In NJ, they are very close to passing a law to limit handgun purchases to one a month. Their goal is to prevent a person from going out and buying a ton of handguns and then going on the street to sell them to the bad guys for a massive crime spree.

What they do not realize, is that criminals do not use legally purchased handguns to commit crimes. They are also not going to buy a handgun at the retail price when it is so incredibly easy to purchase an illegal firearm at the greatly reduces street price.

As usual, these laws are liberal "symbolism over substance".

George, you have been around long enough to know that the liberal ideology is founded on gut feeling, not factual data.

They think that because I only buy 1 firearm a month that it reduces the likelihood of it ending up on the street. What a crock of shyte. No proof that it works, just that there is a group of pathetically stupid morons in this world that do not rely on substance or fact. Like the 34 states that have concealed carry laws on the books have actually seen a DECREASE in firearms related crime and violent crimes - not the increase that the morons at all the gun control groups predict will happen. The same can be said with the spread of the "Castle Doctrine" laws passed within the past few years. No increased violence on the streets because the law-abiding citizens are not going to withdraw their weapon for no good reason.......unlike some little gangbanger who has no respect for a human life.


I suspect that most line police officers have little fear of a properly licensed person with a firearm. Sure it may set their radar up a notch, but if I am pulled over with a firearm on my hip - I guarantee that one of the first things out of my mouth is to say "Sir, I have a loaded firearm in a holster on my right hip." No scumbag lowlife criminal or gangbanger is going to say that.

Then again, I am just an angry white male that is a radical right-wing nut job according to the people in the Socialist state that I reside in. :rolleyes:

You're right. I have been around long enough.

There are occasions when police are leery of licensed firearms holders. Those include domestic disputes, home burglaries (in progress) and the occassional Sec. 8 who is in a barricade situation. But, overall, you are absolutely correct.
